ELLEM Digital Finance Consulting (Pty) Ltd ("ELLEM", "we", "us", "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, and protect information when you visit ellemdigitalfinance.co.za, book a call or submit our contact form, engage our Consulting Services, or subscribe to the ELLEM Plus platform.
This Policy is aligned with the Protection of Personal Information Act 4 of 2013 (POPIA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), and international best practice including GDPR principles.
2. Information We Collect
2.1 When You Contact Us or Book a Call
Name, business name, email address, phone number, and any details you share about your business or enquiry via our Contact page.
2.2 When You Engage Consulting Services or Subscribe to ELLEM Plus
Personal identification details, business/company information, and financial information — including bank statements, trial balances, financial statements, and transaction data — provided to enable reconciliation, reporting, funding-readiness preparation, or platform onboarding (Tier 1, Tier 2, or Tier 3).
2.3 Technical Information
IP address, browser type, device information, and pages visited, collected via cookies and analytics where enabled — see Section 9 below.
3. Legal Basis for Processing
We process personal information on the basis of your consent (e.g. submitting the contact form), performance of a contract (delivering Consulting Services or ELLEM Plus), legal obligation (financial recordkeeping), or legitimate interest (service improvement, security), balanced against your rights.
4. How We Use Your Information
To respond to enquiries and calls booked via our website; deliver Consulting Services (Digital Finance Transformation, AI & Automation Consulting, ERP Advisory & Implementation, Digital CFO Advisory, Governance & Internal Controls, and related pillars); provide ELLEM Plus platform services across Tier 1 (Reconciliation), Tier 2 (Funding Ready), and Tier 3 (Multi-User/Enterprise); process payments; and comply with legal obligations. We do not sell your personal information.
5. Third-Party Tools and Sub-Processors
Depending on the scope of your engagement, ELLEM may process or transmit business/financial data using the following third-party platforms as part of delivering Consulting Services: UiPath, Xero (with G-Accon), Microsoft Power Automate, Zoho Books, and Power BI / Tableau. Each of these providers has its own data processing and security practices. We select and configure these tools with reasonable care, and where feasible, data is processed within the context of the specific client engagement only. Clients may request further detail on which tools are used for their specific engagement.
6. Data Retention
We retain personal and financial information only for as long as necessary for the purposes described above, or as required by South African law (including Companies Act recordkeeping requirements). Information no longer required is securely deleted or anonymised.
7. Data Security
We implement reasonable technical and organisational safeguards, including access controls, multi-factor authentication, and restricted access on a need-to-know basis.
8. International Transfers
Some third-party tools listed in Section 5 may process or store data outside South Africa. Where this occurs, we take reasonable steps to ensure such transfers comply with POPIA's cross-border transfer requirements.
9. Cookies and Analytics
We only use cookies and similar technologies where enabled and required for core website functionality. Should we introduce additional analytics or marketing cookies in future, this section — and, if warranted, a dedicated Cookie Policy — will be updated accordingly and published here.
10. Data Breach Notification
In the event of a security compromise where there is reasonable belief that your personal information has been accessed or acquired by an unauthorised person, we will notify the Information Regulator and affected individuals as soon as reasonably possible, in accordance with Section 22 of POPIA.
11. Direct Marketing
We will only send you direct marketing communications (such as newsletters or promotional updates) where you have given prior, explicit opt-in consent, in accordance with Section 69 of POPIA. You may withdraw this consent at any time by unsubscribing or contacting our Information Officer.
12. Your Rights
Under POPIA, you have the right to be notified of collection, access your information, request correction or deletion, object to processing, withdraw consent, and lodge a complaint with the Information Regulator.
